These terms are subject to change at any time. You are obligated to check these terms regularly to be aware of any changes to them.

Clients are defined as any individual or organization that purchases any of the products or services offered on our website.

Writers are defined as the individuals who produce content to be sold to the Clients of WriterArmy.

Users are any parties that use the website at https://writerarmy.com such as vendors, contractors, affiliates, and others who do not qualify as Writers or Clients.

ACCEPTANCE OF TERMS OF USE

By using the WriterArmy website at https://writerarmy.com you agree to be bound to these Terms of Service with no exceptions. Please read these terms in full before using our website. You are bound to these terms whether or not you are a registered user of this website, and these terms apply to both Clients and Writers. If you do not agree to these terms, you are not allowed to use the services or products offered by WriterArmy.

NATURE OF writerarmy.com

This website offers our clients a platform to purchase original content, articles, and other types of intellectual property created by the writers who register with our service. Regarding our limitation of liability, please read the Section titled LIMITATION OF LIABILITY in this agreement.

ELIGIBILITY

By using the website at https://writerarmy.com you represent that you have the capacity, authority and right to enter into this agreement and abide by all of its terms. We only provide services to individuals who can enter into legally binding contracts, and we do not provide our services to minors or those under the age of 18, as well as anyone who cannot legally work in the United States. All of our Writers must be United States citizens or permanent residents and we require verification of this prior to starting work for our company.

writerarmy.com is intended for use by individuals who are age 18 or older. Writer Army, LLC hereby disclaims any liability which occurs as the result of misrepresentations by our writers or clients in regards to their personal information, age, and eligibility to work in the United States.

ACCESS TO THIS SITE

Writers and Clients both may access this website through our registration system. We require our Writers and Clients to provide us with some data and user information such as their email, address, name, and related information. This registration process is necessary to ensure that our Clients are able to access our ordering system and download their content from our Writers.

You are required to verify your email address after registering with us. Any information that you provide us with must be accurate, current and complete. If you provide us with inaccurate or misleading personal information your access to this website may be terminated at any time. We reserve the right to terminate the membership of any Client or Writer at any time for any reason.

Any account created by a Client or Writer is exclusively for the use of the named individual or organization, and any other party is prohibited from using the account.  Account access may not be transferred or sold to any other individual or organization.

THIRD PARTY FEES

Your use of this website may incur third party fees such as internet or airtime fees from services such as internet providers, cellular providers, and wireless companies. You agree that you are responsible for these fees and that you must provide the necessary equipment to use this website.

THIRD PARTY ADVERTISEMENTS

We may link to third parties and other websites that advertise on our main website or blog. We are not responsible for any content that you encounter from the usage of these websites, and we do not endorse them or screen them. We disclaim any liability for direct or indirect damages that may result from the usage of the third party websites that we link to, and your access and use of these websites is at your own risk.

PRIVACY

In order to use this website you are required to submit certain details about yourself or your business that are mentioned in Section 4 above. The usage of any information that you submit to us is outlined in our Privacy Policy, and by using this website you agree to all of the terms of our website Privacy Policy.

ORDERING CONTENT

Clients may order content through our secure ordering system, and Clients are free to determine the topic, subject matter, and other details regarding the content that they wish to purchase. Clients can select the approximate word count for the content that they wish to purchase, and they can choose from a wide range of content services which are outlined on our Order Content page.

We reserve the right to turn down orders if we do not have the appropriate Writer or if the order is for objectionable or illegal content. Any content order must not violate the rights of any third parties including copyrights and trademarks. We reject any obscene, slanderous, or libelous content orders. We reserve the right to close an account and terminate site access when this policy is not adhered to.

CHANGING ORDER DETAILS

Once an order has been made, the Client must fill out an order intake form with specific questions about the order and its guidelines. Our writers will often immediately take an order and begin work as soon as it has been submitted. Once the order form has been submitted, the guidelines and details for the order cannot be changed without purchasing a new content order.

REFUND POLICY

As a part of our Satisfaction Guarantee, Clients may request a full refund within 7 days after receiving the first draft of their content and after we have attempted at least 1 revision. Full content copyrights and intellectual property rights will be retained by the Writer(s) in the case of a refund. If a Client rejects an order and ultimately requests a refund, the content may not be utilized in any way by the Client.

Usage of any unpaid/refunded content will result in a DMCA Takedown Notice by Writer Army LLC which may result in the removal of the infringing URL or website.

ACCEPTANCE OF CONTENT

Clients can choose to accept the first version of their order that they receive, or request revisions. Revisions must be requested within 7 days after receiving the first draft of the order. The Client has the right to reject the order, but specific details about where the order needs to be improved must be included in the rejection request to allow the writer to revise the content accordingly. If the content is written exactly as the customer describes in the initial order, the rejection request will not be accepted as it will be deemed to be unjustified.

REVISIONS

Clients may request revisions for up to 7 days after the first draft of their work is accepted. Any further revisions after this period of time are at the sole discretion of WriterArmy and are not required. All of our other services have up to 3 revisions included for free, and further revisions will be charged at an applicable and fair market rate based on the current price of our services.

Writers have up to 3 days to send the requested revisions. A longer period of time may be necessary for larger orders. Once the revised content has been delivered, the Client has up to 48 hours to request another set of revisions. If the Client does not reject the revisions in this period of time, the order will be finalized and a refund will no longer be attainable.

CONTENT INTELLECTUAL PROPERTY RIGHTS

The Works produced by the Writers of Writer Army, LLC are “Works Made for Hire”, and according to the Copyright Law of the United States, the Client becomes the sole legal author of “Works Made for Hire” once the Writer is paid in full for the agreed rate.

At WriterArmy our Writers submit original “Works Made for Hire” such as articles, blog posts, sales material, images, texts, software, audio, designs, infographics, graphics, and other intellectual property to our company for acceptance by our Clients. Once our Clients accept the content and the Writer receives payment in full, the Writer relinquishes his or her intellectual property rights over the content including the right to distribute, display, modify, or otherwise use the content for any purpose.

The Writer grants Writer Army, LLC and its licensees and affiliates a non-revocable, non-exclusive, perpetual, fully paid worldwide license to distribute, modify, copy, adapt, use, display and reproduce the Works Made for Hire that they submit to us for payment. We reserve the right to create derivative works, and to create sublicenses based on the aforementioned details. You also warrant that you have the right to grant Writer Army this license for the Works Made for Hire you submit to us.

The Writer agrees that he or she will not be publicly credited for the work by the Client with some exceptions.

Any sample works that Writers submit to apply for a contract or employee position at WriterArmy will not be compensated and will not be published or used by WriterArmy.

Clients obtain full intellectual property rights over any content they purchase from WriterArmy including the right to distribute, brand, modify, edit, and display the content and any other associated rights. Clients who request a refund on any content order may not use the content for any purpose, and the unauthorized use of any content without full payment is subject to legal action.

WEBSITE INTELLECTUAL PROPERTY RIGHTS

This website and all of its designs, features, images, software, text, video, audio, website copy, buttons, icons, animations, blog articles, and other content are owned by WriterArmy, LLC or the licencors of the content and are protected by Untied States copyright law, trademark, intellectual property and patent laws.

You may not modify, edit, distribute, share, use any images, video or audio, graphics, or text on this website or our social media accounts (Facebook, Twitter, Youtube, Google Plus, etc.) without our explicit written permission. Any modification, distribution, downloading or unauthorized use of the content display on this website or our social media accounts is subject to civil and legal action, and offenders will be reported and prosecuted to the fullest extent of the law.

CONTENT ORIGINALITY AND OBJECTIONABLE MATERIAL

Any text, content, articles, images, videos, audios, or other content that is submitted to WriterArmy for the purpose of sale to our Clients must be original and may not infringe on the rights of any third parties including copyrights, trademarks, moral rights and legal rights.

Any submission of unoriginal or objectionable or pornographic content by our Writers is subject to immediate account termination.  WriterArmy, LLC and its owners and shareholders are not be held accountable for any damages to our Clients or Writers that result from the submission of objectionable or unoriginal works.

You agree that you are solely liable for the content that you submit to our website or to Users of our website. You also agree that you will never submit any obscene, abusive, profane, offensive or illegal content to this website or to any User of this website. You agree that WriterArmy may delete any content that it deems to be in violation of our policy regarding objectionable material or potentially harmful to the Users of our website.

NO RECRUITMENT OF WRITERS

Clients are able to semi-anonymously message our Writers through our messaging system which is the only method of direct communication that they may have with our writers, aside for any other communications that are explicitly approved by the executives of Writer Army, LLC.

Users, Clients and Writers agree that they will not attempt to communicate on platforms outside of writerarmy.com and will not share information such as email addresses, phone numbers, screen names, social media accounts, first and last names, or any other personally identifiable information.

Any attempt to solicit, recruit or contact our Writers by circumnavigating WriterArmy is a breach of our Terms of Service and subject to immediate account termination.

PROHIBITED USE

Any breach of the paragraph above or attempt to scrape our website for user information manually or automatically is subject to civil and criminal penalties. You may not use this website in any way that can cause damage to the functionality of the website and its features, or interfere with any user’s experience with the website. You may not use any robot, spider or software to scrape information from this website or copy any material from this website to be republished or otherwise used.

You are prohibited from using any malicious or harmful software including Trojan horses, viruses, spyware, or worms to affect this website or its users, Clients or Writers. You are prohibited from attempting to gain access to any private or secured parts of this website, our server information, or our Client or Writer information. WriterArmy will block the IP addresses of any individuals or organizations that attempt to scrape our website for user information or recruit our writers or clients.

TRADEMARKS

The brand name WriterArmy, our logos, branded works, images, designs, and slogans are trademarks of WriterArmy, LLC and may not be used without our explicit written permission.

LOSS OF DATA

WriterArmy backs up the content submitted to our website by our Writers and purchased by our Clients regularly, however the loss of this data is possible. WriterArmy is not obligated to store or back up data for our Clients or any parties that purchase content from our service, and is in no way liable for any direct or indirect damages that result from the inability to back up this data or save a back up of any content projects that WriterArmy has completed.

DISCLAIMER OF WARRANTY

Our services and this website is provided on an “as is” basis without any warranty, implied or expressed including any implied warranties of quality, accuracy, completeness, or suitability for a particular purpose other than the warranties which are inescapable of exclusion under relevant laws in your jurisdiction.

We are not responsible for any direct or indirect damages that occur from the download or use of content or data from our website.

We do not guarantee any specific result or benefit for the use of our website.
